Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of the DRIVYN website, platform, rental vehicles, and related services (“Services”).
By using our Services, you agree to comply with this AUP, the DRIVYN
Terms of Service, and the Subscription Agreement.

1. General Conduct

You may only use the Services for lawful purposes and in compliance with all applicable laws and regulations.
You agree
not to:

Use a DRIVYN rental vehicle in violation of any local, state, or federal laws.

Engage in fraudulent, deceptive, or misleading conduct.

Provide false, incomplete, or misleading information during onboarding, insurance verification, or any part of the rental process.

Interfere with, disrupt, or compromise the security or functionality of DRIVYN systems, vehicles, or equipment.

Damage, alter, or modify DRIVYN property without authorization.

2. Prohibited Vehicle Uses

When operating a rental vehicle from DRIVYN, you agree not to:

Operate the vehicle under the influence of alcohol, drugs, or any other substance that impairs your ability to drive safely.

Use the vehicle for:

Racing, speed testing, or off-road driving.

Towing or pushing another vehicle or object.

Hauling hazardous materials.

Transporting passengers for hire (except as part of an approved rideshare or delivery program under the rental agreement).

Permit unauthorized individuals to drive the vehicle.

Leave the vehicle unlocked or with the keys inside while unattended.

Use the vehicle in a reckless or negligent manner that risks safety or property damage.

3. Rental Period & Return Requirements

You must return the vehicle on the agreed end date, time, and location unless an approved extension has been granted through the Extension Form process described in the Subscription Agreement.

Failure to return the vehicle on time without extension approval may result in additional charges, repossession, and/or legal action.

The vehicle must be returned in the same condition in which it was provided, except for normal wear and tear.

4. Maintenance & Damage Responsibility

You are responsible for basic upkeep during your rental period, such as maintaining fluid levels and tire pressure.

You must report any mechanical issues or damage to DRIVYN immediately.

You are financially responsible for:

Any damage to the vehicle beyond normal wear and tear.

Loss of or damage to rental equipment or accessories.

Costs arising from accidents caused by your negligence or breach of this AUP.

5. Documentation & Insurance Compliance

You must comply with all insurance documentation requirements outlined in the Subscription Agreement.

Failure to upload valid proof of insurance within 48 hours of receiving the Onboarding Form will result in cancellation and refund as per DRIVYN’s cancellation policy.

Providing fraudulent or altered insurance documents will result in immediate termination of your rental and may result in legal action.

6. Communication Consent

You agree that DRIVYN may contact you via SMS, MMS, phone calls, and email for operational updates, return reminders, billing notifications, and other service-related purposes.

All communications will comply with applicable APC and 10DLC messaging standards.

Standard messaging rates may apply.

7. Enforcement & Violations

DRIVYN may suspend, terminate, or refuse Services for violations of this AUP.

We may report illegal activity to law enforcement and share relevant customer data as required by law.

Violations may result in fees, damage charges, repossession, or legal claims.

8. Changes to This AUP

We may update this Acceptable Use Policy at any time by posting a revised version at Acceptable Use Policy. Continued use of our Services after changes are posted constitutes acceptance of the updated policy.
